Using opt-out players to get cap room

Assuming the Heat-Suns trade goes down, I have a question from the Heat's perspective.

This offseason, could the Heat "encourage" Marion to opt out of his contract, use the cap space that would provide to sign a FA, then, once the FA is already on the payroll, resign Marion and go over the cap? Obviously it would take a lot of handshake "wink wink" deals, but is that possible?

To have capspace if Marion opts out, he'd have to be renounced, otherwise he has a mahoosive cap hold. Renouncing him means that they lose the ability to re-sign him without dipping into their cap space. Thus, they'll lose him.

So there's no reason for them to do so.
